PESHAWAR, May 6: The Peshawar High Court (PHC) has asked the federal government to file a reference in the parliament for suitable amendments to the Constitution to protect fundamental rights in the tribal areas.
A larger bench of the court gave this ruling in a detailed judgment over matters related to illegal detentions and issues of government servants.
According to the judgment, the court should have jurisdiction in the tribal areas and the federal and provincial government employees of the tribal areas should have the right to be heard by the high court.
The court also said that it might interfere if the political administration of tribal areas arrested someone from the settled areas and then transferred him or her to a tribal agency.
The high court said the parliament should amend the Constitution of Pakistan to bring a positive change in the FATA region.
