PHC released Man convicted by Pol administration
PESHAWAR: A bench of Peshawar High Court (PHC) on Friday has set aside the conviction of an accused who was sentenced to 25 years of the sentence by the erstwhile political administration of the Khyber Agency.
The order of his forthwith release from central prison Peshawar was issued by a two-judge bench comprising Chief Justice Waqar Amad Seth and Justice Muhammad Ayub Khan while hearing a writ petition filed Lal Zada, a resident of Bara tehsil, district Khyber.
The attorney for Lal Zada, Shabier Hussain Gigyani argued in the court that the accused was allegedly arrested by Khasadar force on March 12, 2014, from driving seat of a truck loaded with goods. However, on thorough search, it was found that there were 21 sacks full charas weighing 500 kg.
The charas was being smuggled from Afghanistan to Pakistan and case was registered under Narcotics law and then sentenced by Political Agent, Khyber after Jirga proceedings. The writ petition was allowed and the sentence was reduced on sole point of irregularity in taking the samples from contraband as instead of separate samples, consolidated samples were obtained by khasadar force for sending to Forensic Science Laboratory.
