GHALLANAI: In an open violation of the orders of the Peshawar High Court (PHC) barring the administrations of the tribal districts from exercising judicial powers, the administration of Mohmand tribal district kept over 30 people in detention for several days.
The administration of Mohmand tribal district arrested 30 members from Malik Subedar group in Ziarat area of Safi tehsil few days ago when they were staging protest over a dispute of ownership of marble mines with a rival group. Twenty arrested persons were released two days ago, while the remaining detainees were released on Wednesday. The administration officials did not share any details about the arrest of the tribesmen.
Malik Subedar confirmed the arrest of his fellow tribesmen and said it was an open violation of the court order.
The legal community has also expressed concern over the attitude of the district administration. Ali Azeem Afridi, an advocate at the PHC, said the administration has technically committed a contempt of court by arresting the protesting tribesmen.
In a landmark verdict on 30 October, the PHC barred the administrations of the tribal districts from using judicial powers. The court had and ordered the Khyber Pakhtunkhwa government to make arrangements for extension of judiciary to tribal districts.
The KP government had challenged the PHC verdict in the Supreme Court of Pakistan.
