PESHAWAR: Justice Ikramullah Khan of Peshawar High Court (PHC) Saturday ordered the Khyber Pakhtunkhwa advocate General to deposit Rs10 thousand in the dams fund created by the Supreme Court after his failure to submit reply in a petition, despite the courts’ order.

The order was issued by a two-judge bench comprising Justice Ikramullah Khan and Justice Mussarat Hilali while hearing a writ petition filed by a prisoner, Zahir Shah, for remission in the sentence on the ground of education, he has secured inside the jail cell.

“When an inmate manages to get higher education inside the jail cell, under the law, he is entitled to remission in the sentence,” his attorney Nosheen, argued in the court. Nosheen Advocate added that her client has completed higher education but the government has for not given him any remission in his sentence.

During the previous hearings of the case, the PHC has directed Advocate General, Khyber Pakhtunkhwa to ensure the governments’ response to the petitions, however, despite repeated orders, he couldn’t submit the response.

In Previous hearing, the court was told that the comments have been submitted in the office, but there were no comments available on record. Due to which the Justice Ikramullah imposed a fine of Rs10 thousand to be submitted before the next hearing of the case.
